Oral or written argument Essay Given that the ideas can not be truly and completely explained by words, one have to recognize that every oral or written argument ever told or explained is inherently subjective. Therefore, every fact described by a human is an opinion, and every opinion is somehow a fact. Thusly, every word should be considered from two points of view: from the point of view of fact and from the point of view of opinion. This relates to the testimony before the court as well. Every judge should realize, that even the most honest person can interpret the facts wrongfully or simply mistake. Moreover, even the judge himself is not free from subjectivity, although the level of objectivity is one of the key factors determining his or her professionalism. Therefore, upon examination of the testimony, a judge has to consider it as one fact and witnesses probable level of subjectivity as another fact. At that it would be useful to classify the questions put before a witness during examination into two groups. Some of the questions are questions of fact (whats happened? ), other questions are questions of opinion (do you think that? ). For sure, the second kind of questions includes a greater extent of subjectivity, although the first kind can not be recognized completely objective as well. In order to find out the truth, all the testimonies have to be reviewed in combination. Neither of the testimonies can be absolutely true and accurate. Only consideration of the testimonies and other proofs in the case would allow a judge to create a more or less straight story of the case. Question 2 As a judge, I have to answer several questions in order to determine whether a person with multiple personality disorder should witness or not. Firstly, I have to find out whether a person can witness at all. In order to do that I would call the experts to examine that personss mental condition and his or her state at the moment. In case the experts recognize, that the person is principally able to provide a valid testimony, I would further doubt his or her possible words and ask myself a second question: how critical the persons testimony is for the case and how can it influence my view of the case. My decision can not be bases solely on the testimony of mentally infringed individual, yet his or her testimony may be usefull for clarification of some circumstances. I would rather rely on such witness to determine the facts, than in case I needed his or her opinion. In case I came to a conclusion, that I still need this witness, I would properly examine him or her in the presence of the experts who would observe the individuals behavior during examination and inform me of possible deviations. Having completed the examination, I would consider how much do the words of the witness conform with other testimonies and proofs in the case. In case I would find no logical controversions, I would consider the words of such witness as a valid testimony. A large number of tools and techniques have been developed in the past to ensure optimal allocation of funds. Various authors have approached the study of working capital management in different ways. A large number of models, theories and techniques (Baumol 1952, Beranek 1963, Haskel Benishay 1965, Haley and Higgins 1973, Walker 1974) have been developed in the past towards the optimal allocation of funds. Efficient use of working capital has a direct bearing on profitability of an enterprise. it increase the productivity of in fixed assets. Basic Survival of a firm may be stake if adequate working capital is not available in time. It is essential to maintain constant supply of working capital for healthy growth of an enterprise. Working capital management concerned with current asset and current liabilities. Profitability and liquidity of a company directly affects current asset and current liabilities. So working capital management is considered as most important component of corporate finance. To show the relevance of working capital there are many factors. As far as a typical manufacturing firm is concerned, it accommodates half of its total assets as current assets. More current asset enhances more return on investment. A firm with fewer holdings of current assets would face immense difficulty to carry on the day to day operations of the company (Horne and Wachowicz, 2000). Efficient working capital management involves planning and controlling current assets and current liabilities in a manner that eliminates the risk of inability to meet due short term obligations on the one hand and avoid excessive investment in these assets on the other hand (Eljelly, 2004). Many surveys have indicated that managers spend considerable time on day-to-day problems that involve working capital decisions. One reason for this is that current assets are short-lived investments that are continually being converted into other asset types (Rao 1989). With regard to current liabilities, the firm is responsible for paying these obligations on a timely basis. Liquidity for the ongoing firm is not reliant on the liquidation value of its assets, but rather on the operating cash flows generated by those assets (Soenen, 1993). Taken together, decisions on the level of different working capital components become frequent, repetitive, and time consuming. Working Capital Management is a very sensitive area in the field of financial management (Joshi, 1994). It involves the decision of the amount and composition of current assets and the financing of these assets. Current assets include all those assets that in the normal course of business return to the form of cash within a short period of time, ordinarily within a year and such temporary investment as may be readily converted into cash upon need. The Working Capital Management of a firm in part affects its profitability. The ultimate objective of any firm is to maximize the profit. But, preserving liquidity of the firm is an important objective too. The problem is that increasing profits at the cost of liquidity can bring serious problems to the firm. Therefore, there must be a tradeoff between these two objectives of the firms. One objective should not be at cost of the other because both have their importance. If we do not care about profit, we cannot survive for a longer period. On the other hand, if we do not care about liquidity, we may face the problem of insolvency or bankruptcy. For these reasons working capital management should be given proper consideration and will ultimately affect the profitability of the firm. Firms should keep an optimal level of working capital that maximizes their total value. Larger inventory preservation might reduce the risk of a stock-out. Keeping large level of inventory and a generous trade credit policy would cause to high sales. Allowing trade credit is most strategic move to stimulate sales. Trade credit would give a chance to customers to assess quality attributes of product before making payments completely or partly (Long, Maltiz and Ravid 1993, and Deloof and Jegers, 1996). Accounts payable is another most important component of working capital. Investing in account payable or delaying payments to suppliers allow a firm to assess the quality of acquired product before it making its full payments. Investing in accounts payable is treated as inexpensive and flexible source of financing working capital. Bad effect of investing accounts payable is that, it would become loss if the firm offered discount for early or on time payment. Measurement of working capital is most important function of management. A popular measure of Working Capital Management (WCM) is the working capital cycle or operating cycle. This is the time lag between the expenditure for the purchases of raw materials and collecting cash from the debtors. With the reducing of cash conversion period that will be more beneficial to the working capital and it will lead to high level of current asset. As it increases the cash conversion period it will lead to low level of working capital maintena nce. Providing a proper and sound framework for total asset management is most important aspect in financial management practices. Investment in fixed asset would require great level of research activity. Recently, working capital management has been given little attention by researchers relatively. This approach causes great problem for many business firms. Because neglecting of working capital or lazy approach on working capital management would cause utter failure and becomes problematic. Recent corporate history and literature shows that more concerns for working capital management will result in more efficiency. Recent corporate history has got rich set of history for the collapse of firms due to their neglects in working capital management. Altman provided a model called multivariate predictor model based on US companies in the year 1968. In his model he includes working capital as one of the model components. Taffler developed a four-variable model for failure prediction using data drawn from the UK companies in the year 1977. (Eljelly, 2004) explains that liquidity management involves planning and controlling of current asset and current liabilities in a manner that reduce risk maximum. Major risk in these involves incapability to meet short term obligation as and when it dues. It should also concerns with avoiding excessive investment in current assets. The measurement of relation between profitability and liquidity is most important. To measure this relationship there are many techniques are being used such as ratios and cash conversion cycle. Some companies as in Soudi Arabia was under study as sample. Researchers used correlation and regression technique to study the relationship between profitability and liquidity of certain companies. The study showed that, rather than the ratios such as current ratio and liquidity ratio cash conversion cycle has more relevance to project out the relationship. Another point revealed that size of the companies showed major affect on profitability of various industrie s. The study revealed certain implications in Soudi Arabian companies. First is that there is negative relationship between liquidity and profitability indicators like current ratio and cash conversion period. Second is that there is variation among companies in terms of measure of liquidity. In spite of all the overall study revealed stable result. (Ghosh and Maji, 2003) Under this, they take Indian cement companies in to consideration to study in details. They examined and studied the efficiency of working capital management of certain Indian cement companies during the financial period 1992 1993 to 2001- 2002. Instead of using the working capital ratios they have used performance, utilization and efficiency indices calculations. Each individual firm has got target efficiency level on the basis of industry norms. And each firms speed level of achieving efficiency target is tested under study. Overall study concluded that during particular study period, Indian cement companies did not performed as the targeted as well. (Deloof, 2003) He explains that, the way that a firm is managing its working capital has significant impact on ultimate profitability of any firms. This is because of the great amount cash investment done by most firms in current assets. He made study by using correlation and regression tools in Belgian firms. During his study he found that there is negative relationship between gross operating income and number of days allowed in account payable, account receivables and inventories of firms. Based on the study he conducted, he concluded that management can reduce the number of days in account receivables and inventory storage reasonably. It will create more value for its shareholders and owners. He also concluded that negative relationship between profitability and accounts payable is due to the reason that less profitable firms take more times to make payment on their bills. (Shin and Soenen, 1998) To create certain value to owners or shareholders it is important that to mange working capital most significantly and with utter cares. The problem arose because the maximization of the firms returns could seriously threaten its liquidity, and the pursuit of liquidity had a tendency to dilute returns. This article evaluated the association between traditional and alternative working capital measures and return on investment (ROI), specifically in industrial firms listed on the Johannesburg Stock Exchange (JSE). The problem under investigation was to establish whether the more recently developed alternative working capital concepts showed improved association with return on investment to that of traditional working capital ratios or not. Results indicated that there were no significant differences amongst the years with respect to the independent variables. The results of their stepwise regression corroborated that total current liabiliti es divided by funds flow accounted for most of the variability in Return on Investment (ROI). The statistical test results showed that a traditional working capital leverage ratio, current liabilities divided by funds flow, displayed the greatest associations with return on investment. Significance Gross working capital concept focuses attention on the two aspect of current asset management. They are: 1). Optimum investment in current assets: Investment in current asset must be just adequate to the needs of the firm. On the other hand excessive investment in current asset should be avoided. 2). Financing of current asset: Need for working capital arise due to the increasing level of business activity. Therefore, there is a need to provide it quickly. Net Working Capital Concept As per this concept the excess of current asst over current liabilities represents net working capital. Similar view is expressed by Guttmann, Gerstenberg, and Goel Etc. Net Working Capital represents the amount of current asset which remain after all the current liabilities were paid. It may be either positive or negative. It will be positive if current asset exceed current liabilities and vice versa. To quote Roy Chowdry, Net Working Capital indicates the liquidity of the liquidity of business whilst gross working capital denotes the quantum of working capital with which business has to operate. Significance Net Working Capital Concept focuses on two aspects. They are: 1). Maintaining liquidity position: Excess current assets help in meeting its financial obligation within the operating cycle of the firm. Negative and excess working capitals both are bad to the firm. 2). to decide upon the extent of long term capital in financing current asset: Net working capital means the portion of current asst that should be financed by long term funds. Permanent Working Capital This is the minimum investment kept in the form of inventory of raw materials, work in process, finished goods, stores and spares and book debt to facilitate uninterrupted operation in a firm. Though this investment is stable in short run, it certainly varies in long run depending upon the expansion programs undertaken by the firm. It may increase or decrease over a period of time. Temporary Working Capital Any additional working capital apart from permanent working capital required to support the changing production and sales activities is referred to as temporary working capital. Larger investment in current assets with less dependence on short-term borrowing increases liquidity reduces risk and thereby decreases the opportunity for gain or loss. In other words, there is a definite inverse relationship between the degree of risk and profitability. A conservative management prefers to minimize risk by maintaining a higher level of current assets or working capital while a liberal management assumes greater risk by reducing working capital. However, the goal of the management should be to establish a suitable tradeoff between profitability and risk. Principle of Cost of Capital The various sources of raising working capital finance have different cost of capital and the degree of risk involved. Generally, higher the risk lower is the cost and lower the risk higher is the cost. A sound working capital management should always try to achieve a proper balance between these two. Principle of Equity Position The principle is concerned with planning the total investment in current assets. According to this principle, the amount of working capital invested in each component should be adequately justified by a firms equity position. Principle of Maturity of Payment This principle concerned with planning the sources of finance for working capital according to this principle, a firm should make every effort to relate maturities of payment to its flow of internally generated funds. Maturity patterns of various obligations are an important factor in risk assumptions and risk assessments. Importance of working capital management: To maintain sound working capital position is critical and important function for any management. Because the success of business is very much depends on how they manage its working capital. It should keep preserve a sound working capital position by avoiding excessive investment and keeping adequate working capital to meet daily operations. . That is if the size of business is large it would require more working capital and it is small it would require less amount of working capital to invest. 2). Nature of business activity: There are some firms which requires very short amount to be invested in fixed asset and more in current asset. Likewise, some firms would require more investment in fixed asset and less in current asset. This is why the nature of business comes more significant while determining the working capital. How important is the setting in the short stories you have read? In this assignment I will analyse 5 short stories, which are all pre 1914. These are ââ¬â ââ¬ËThe man with the twisted lipââ¬â¢, by Sir Arthur Conan Doyle, ââ¬ËThe Red Roomââ¬â¢, by H.G Wells, ââ¬ËThe Signalmanââ¬â¢, by Charles Dickens, ââ¬ËA Terribly Strange Bed,ââ¬â¢ by Wilkie Collins and ââ¬ËThe Ostlerââ¬â¢, also by Wilkie Collins. The stories all have an exterior location. For example, in the Red Room, the corridors on the way to The Red Room. The language H.G Wells uses, such as ââ¬Ëhauntedââ¬â¢, ââ¬Ëdarknessââ¬â¢ and ââ¬Ëshadowyââ¬â¢ create a feeling of tension and suspense. This is even before you have reached the main setting. Compared to The Signalman, the way the settings are portrayed, there is very little difference. Some of the words used by Charles Dickens, such as ââ¬Ëdarkââ¬â¢, ââ¬Ëgloomy red lightââ¬â¢ and ââ¬Ëcoldââ¬â¢. Some similarities are that they both talk about darkness and lack of light. The interior settings play a significant part in most of the stories. The man with the twisted lip, there is an opium den. This sets the scene to a dark and gloomy setting, just as the authors did with the exterior setting. The authors are always using dark and gloomy symbolism. The opium den is described as ââ¬Ëgloomyââ¬â¢, ââ¬Ëdarkââ¬â¢ and ââ¬Ëblack shadowsââ¬â¢. This gets you on the edge, and you want to read on. In comparison to The Red Room which uses shock and surprise. Where it says ââ¬Ëthe young duke had diedââ¬â¢, it goes on to say, ââ¬Ëheadlong down the stepsââ¬â¢. This immediately shocks you because it is such a horrific death. This therefore is a very important part of the setting. In addition, when the candles start to go out, the character panics. The writer uses phrases such as ââ¬Ësuddenly went outââ¬â¢, ââ¬Ëblack shadow sprang back to its placeââ¬â¢ and ââ¬Ëdarkness was there.ââ¬â¢ This excites the reader, and you want to read on. Also the writer uses short, sharp sentences to emphasise the panic and terror, which the character is feeling. Also the sub characters help to portray the eeriness of the story. In The Red Room, there is a man with a ââ¬Ëwithered armââ¬â¢, and another with ââ¬Ëdecaying yellow teethââ¬â¢. To the reader this is a very unpleasant and sickening thought. The people who spread the myth of The Red Room help to give out a horrific feeling to the story. Historical Misconceptions About Abraham Lincoln and John F. Kennedy :: American America History
All Presidents have faced the challenge of keeping people united in times of conflict and turmoil; this specifically applied to Presidents Abraham Lincoln and John F. Kennedy. They were faced with solving delicate situations involving segregation and the civil rights of American citizens in two different centuries. While there has been the enduring impression that both presidents held high ideals with regard to the African American population, a closer examination of history could lead one to believe that Lincoln was the false freer of the enslaved and Kennedy was the false figurehead for the Civil Rights movement. Abraham Lincoln entered his first term as president following the leaders Franklin Pierce and James Buchanan. Pierce was known as "an outspoken critic of federal involvement in state and locale issues" (http://www.npr.org). His veto of a bill which would have provided services and support for the mentally handicapped "established the rationale behind government uninvolvement in public health issues into the twentieth century" (http://www.npr.org). This climate of governmental uninvolvement persisted into the term of James Buchanan, a time well-known for the Dred Scott decision, which stated that "congress had no constitutional power to deprive persons of their property rights in slaves in the territories" (http://www.whitehouse.gov). Later, Buchanan "reverted to a policy of inactivity that continued until he left office" (http://www.whitehouse.gov). Therefore, upon entering office, Lincoln found the stage set for an uphill climb with a sharply divided country and a government unused to active leadership by a president whose main agenda was to unite the country, even if this meant an involvement in previously "untouchable" states rights. The issue of slavery was at the center of the controversies, and decisions in the previous two administrations only compounded the difficulties encountered in any actions that Lincoln might make. The issue of segregation continued even up to one hundred years later when Kennedy became president following Harry S. Truman and Dwight D. Eisenhower. However, unlike Pierce and Buchanan, the decisions and actions of both of these presidents should have made any stand that Kennedy would take for the civil rights movement easier. No Longer at Ease The story explores the conflicts in Obi Okonkwo's life. He is a young man from Eastern Nigeria who has to develop his career in the midst of all his problems. He is pressurised by the men of his tribe, the Umuofia Progressive Union, not to forget his traditions and to pay his dues to they helped him to be educated. He is also faced with the conflict of adhering to the Christian principle his father Isaac Okonkwo, a staunch Christian, raised him with and the seduction of the so-called ââ¬Å"evil Western influencesâ⬠on the younger Nigeria generation. Moreover he falls in love with a woman, Clara, who is considered by tribe to be from a cursed family. His parents don't approve of his engagement to her and he has to choose between his love for her or pleasing his family and tribe. Loved it No Longer at Ease is beautifully written book about colonialism and the alienating influence it has on those Africans who lose touch with their roots as they try to adapt to the changing times. I enjoyed this rich, challenging and fascinating story. The struggles of the protagonist, Obi Okonkwo, a twenty-six year old Umuofian educated in the British Colonial system and at the university in Great Britain, are analogous to the struggles facing Nigerian society during the period at the end of ... ...ose and becomes one of many bribe-taking officials that he formerly despised, leading to a tragic end. In many ways, No Longer at Ease reflects upon the problems facing much of Africa today, corruption and tradition conflicting with progress. The western world may condemn their rampant corruption as Obi first did but it is at the bottom of a spiral of other problems. Chinua Achebe continues to use his characteristically simple style evident in Things Fall Apart for No Longer at Ease. He combines phrases in native languages and uses folk tales to illustrate examples. Unfortunately, the simplicity of the language does not serve to keep the reader's interest completely. At times it feels choppy and almost too simplistic, leaving out details that could serve to further the story. Nevertheless, No Longer at Ease is a remarakble parable of modern Africa. Law Self Reflection for Mgt388 Module
Self-Reflection I didnââ¬â¢t think that management and law were important to me before I came to the UK. I did accounting in my high school but it was all just about getting high marks. This is because I have always been studying scientific things and I didnââ¬â¢t think that the lack of knowledge about law and finance would affect or bother me. This was until I moved into a house, and the landlord refused to pay me back my deposit as we only had an oral agreement; no contract was made. Furthermore, I started a business on eBay. I discovered I managed my business poorly as I didnââ¬â¢t keep any records.From that moment, I felt that I needed to improve my ability to manage my money and be professional with my future jobs. MGT388, this module gave me a chance to study something that I indeed wanted to learn. Learning: This module gave me a chance to learn things in another field I havenââ¬â¢t touched before. I felt challenged, but I was excited. I attended every lecture and most of the tutorials in the 10 weeks, and studied hard by reading extra information as I knew the importance of this module related to my present and my future career. I found out that taking notes in colourful pens and doing mind maps helps me a lot in learning.Experience: I enjoyed the law tutorials. We discussed with the tutor based on real scenarios. It was not the traditional learning pattern, it was more interactive. We had a chance to say what we thought and judge the colleagues' opinion too. The tutor in my tutorial is a really nice lady, she is very patient and explains things really clearly. Reflection: The coursework and the online tests are the best reflections from the module. The team coursework not only revised what we have studied, it also improved my leadership and communication skill.It helped me develop more understanding about company management and contract. I found that the four management accounting tests were really helpful; I did each test two times so that I understand where I went wrong. I always improved on the second test as I read the comment of the question and reconsidered the situation in the question. Abstraction: From MGT388, I learnt many new things that I think would help me a lot for my career in the future. The module is an overview of management and law, but the topics in the module are carefully chosen for engineering students.This changes my viewpoint about engineering. Sometimes engineering is not only about calculations and designs. Sometimes, costs and avenues are important too for a company to survive. Learning: In the future, I will apply the knowledge I learnt from this module to my eBay business, and try to get a better management experience from my small business. This is a small practise before I go to a real company for work. Maybe I am going to make mistakes, but I think this module gives me the ability to study and review more information and knowledge.

The Purchase of Alaska
There are many states in North America. Formally known as the United States of America. From New York to California, you could find millions of different types of people, and cultures from around the world. But how about a state that is so isolated from them all, that many people forget it was even added as the 49th state to the country? The lone state of Alaska is to the north west of the major states and if laid on top of the other states, would cover about two-thirds of the land. And for a state that is so large, it is surely simply thought of as the coldest state.Alaska is much more then that, and has a lot of history behind just a land of snow and mountains. Alaska was discovered in 1741 by Russian settlers and had been colonized by them in 1784. With over 660 thousand square miles, Alaska was surely a big find by the Russian settler Vitus Jonassen. Not much was done at the time with Alaska, for the living conditions were really rough and treacherous. It took about forty years f or the first settlements to come about in Alaska. Grigorii Shelikhov and his wife Natalia came to the Kodiak Islands along the coasts of Alaska and made a settlement along with hundreds of their kind.This was the first settlement of Alaska. From then on, settlers from Russia, Britain, the Spanish, and even American explorers and adventurers all settled in Alaska. Russia was going through financial issues and did not have sufficient funds for their country. ââ¬Å"In 1867 United States Secretary of State William H. Seward offered Russia $7,200,000, or two cents per acre, for Alaskaâ⬠(3). This was Sewardââ¬â¢s most pronounced achievement as Secretary of State, and kept the British from taking over Alaska.This brought much more land into the United States at an extremely cheap price of 7. 2 million dollars. This purchase increased the value of America as a whole and offered many more revenues and resources. There were resources such as the huge line of seafood and fishing. Mos t of the seafood at the time and currently for America is brought out from the waters that surround Alaska. Most of Alaska was not explored during the time of purchase and the full benefit of Alaska was not known. After many years of exploring and the tate becoming close to what it is today, there was a discovery of oil in 1968 and this would, ââ¬Å"have the most recoverable oil of any field in the United Statesâ⬠(5). After such a find, the purchase of Alaska seemed like an amazing idea, even though Seward had no idea at the time of purchase. In 1977, a pipeline for the oil recovery was laid down, and is now able to draw over eighty thousand barrels within only one hour, and the pipeline runs eight hundred-eighty miles from the top of Alaska to the bottom, going straight thru mainly the middle of the state.Even though America was bought off of Russia back in 1867, it was not a state instantly. In fact, it wasnââ¬â¢t even close. The population was far to low for it to becom e a state and also needed proper governing to be taken into consideration of being a state, ââ¬Å"â⬠¦worried that Alaska's population was too sparse, distant, and isolatedâ⬠¦too unstable for it to be a worthwhile addition to the United Statesâ⬠(5). Under president Eisenhower, Alaska was signed on as a state by the Alaska Statehood Act on July 7th, 1958.Overall, Alaska has brought many new and useful resources into America since it was bought and turned out to be more then just a beautiful place, but a place with plenty to offer.
